Privacy Policy

This is the Privacy Policy of Stag’s Leap Wine Cellars, LLC, a member of the Antinori California, Inc. family of wines. We respect your concerns about privacy and value the relationship we have with you. This Privacy Policy describes the types of personal information we collect on this website. Our Privacy Policy also describes how we may use the information that we collect, to whom and under what circumstances we may disclose it, and the measures we take to protect the security of the information. We also tell you how you can contact us to address questions you may have.

We are based in California and this Privacy Policy advises you of rights under the California Consumer Privacy Act of 2018 as amended, including the California Privacy Rights Act effective as of 2023. We provide the same rights to all users, whether or not they are residents of California.

  1. Notice of Collection and Use of Personal Information

We may collect the following categories of personal information about you:

  • Identifiers: identifiers such as a real name, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, and similar technology; telephone number and other forms of persistent or probabilistic identifiers), online identifiers, internet protocol address, email address, account name, and other similar identifiers
  • Secondary Identifiers: signature, physical characteristics or description, state identification card number, education, bank account number, credit card number, debit card number, other financial information, medical information, and health insurance information
  • Protected Classifications: race, age, and gender
  • Commercial Information: commercial information, including records of personal property, products or services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies
  • Online Activity: internet and other electronic network activity information, including, but not limited to, browsing history, search history, information regarding your interaction with websites, applications or advertisements, referring URL, your IP address, which browser you used to come to the website, and the pages of our website that you viewed during your visit
  • Geolocation: geolocation data
  • Sensory Information: audio, electronic, visual, and similar information
  • Employment Information: professional or employment-related information
  • Inferences: inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, predispositions, behavior, and attitudes.

We may use the categories of personal information listed above for certain business or commercial purposes, as described in this table:

2. Our Prior Collection, Use and Disclosure of Personal Information

We may have collected and used your personal information, as described in section 1 above, during the 12-month period prior to the effective date of this California Consumer Privacy Policy. For the personal information collected during that timeframe, we describe below: (a) the categories of sources from which we may have obtained the personal information, (b) the categories of third parties with whom we may have shared the information, (c) the categories of third parties to whom we may have disclosed the information, and (d) the categories of personal information we may have disclosed for a business purpose.

We may have obtained personal information about you from various sources, as described below.

     b. Sharing of Personal Information

We do not share your personal information outside of the Antinori California family of wines for third party advertising purposes.  We do not knowingly share personal information of consumers under 16 years old.

We share email addresses of some of our consumers with their financial institutions where those consumers have purchased our products as a result of a referral from their financial institution to us, so that the financial institution can confirm that those consumers are the financial institution’s customers.

     c. Disclosing Personal Information

We may have disclosed your personal information to certain categories of service providers and third parties, as described below.

     d. Sale of Personal Information

We have not sold personal information to any third parties in the preceding 12 months.

3. Sensitive Personal Information

We do not use or disclose sensitive personal information for purposes for other than those set forth in Cal. Civ. Code § 1798.140(e)(2), (4), (5), (8) or Cal. Code Regs., Tit. 11, § 7027(m). We collect Sensitive Personal information, including social security numbers, driver’s license numbers and passport numbers, only from our employees or prospective employees. We do not retain sensitive personal information from our customers.

4. Retention of Personal Information

We generally keep personal information for as long as is reasonably necessary to achieve the purposes for which the personal information was collected, another disclosed purpose that is compatible with the context in which the personal information was collected, or for as long as is required by law.  In determining the retention period, we will consider factors such as the nature and sensitivity of the personal information, the purposes for which we collected the personal information, any other disclosed purpose that is compatible with the context in which the personal information was collected, the potential risks of retaining the information, and any requirement to retain that information in order to comply with laws and regulations.

For example, we retain personal information related to your account for so long as you keep an account with us, unless you ask us to delete it, including identifiers, secondary identifiers, and commercial information so that you and we can have a record of your purchases.

We retain employment information for varying periods of time depending on the nature of the information.  For example, we generally keep employee personnel files for up to four years after the employee’s employment with us ends.  We generally retain information collected in connection with employment applications for up to four years after we receive the application.

5. Rights Under the California Consumer Privacy Act

You have certain choices regarding our use and disclosure of your personal information, as described below. You have the following rights:

  • Right to know: You have the right, up to twice in a 12-month period, to request that we confirm whether we have collected personal information about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information;
  • Access: You have the right, up to twice in a 12-month period, to request that we disclose to you the personal information we have collected, used, disclosed and sold about you during the past 12 months.
  • Deletion: You have the right to request that we delete certain personal information we have collected from you.
  • Correction: You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Opt-Out of Sale or Sharing: You have the right to opt-out of the sale, or sharing for cross-context behavioral advertising, of your personal information.  We do not sell or share our customers’ information other than within the Antinori California family of wines, our parent company, and affiliates, or for carrying out our business with you. You may opt out of the sharing of information from our website, or manage cookies, using the links on the website at https://www.stagsleapwinecellars.com.
  • How to Submit a Request: To submit a request to exercise any of the rights above, please send us an email at compliance@slwc.com with your full name and your e-mail address, call  1-800-267-6793 or visit Do Not Sell or Share My Personal Information.
  • Right to Freedom from Discrimination of Retaliation: You have the right not to be discriminated or retaliated against for exercising any of the above rights.

Verifying Requests: To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request. If you request to access or delete your personal information, we may require you to provide information such as: physical address, date of birth, and phone number. In addition, if you ask us to provide you with specific pieces of personal information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request; for a request to delete, request to correct, or a request to know, we will pay for or compensate you for the cost of obtaining a declaration and if we will reimburse you, we will give you reimbursement instructions before you give us the declaration. If you designate an authorized agent to make an access, deletion, or opt-out of sale request on your behalf, we may require you to provide the authorized agent written permission to do so, and, for access and deletion requests, we may also require you to verify your own identity directly with us (as described above). To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

6. Rights Under California’s “Shine the Light” Law

If you reside in California, you have the right to request that we provide you with (1) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (2) the identity of those third parties. 7. Opting Out of Marketing and Promotional Messages

If you decide to opt-out of receiving marketing or promotional messages, keep in mind that these preferences regarding promotional contacts do not mean that we might not contact you for other reasons, such as those related to an order you placed, an inquiry you made, a message that a friend or acquaintance requested be delivered (such as through our Forward to a Friend program), a membership you undertook, an event for which you registered, or a legally required notice.

You may stop the delivery of future marketing and promotional e-mail from us by clicking on the unsubscribe link provided, but note, it may take up to 10 business days to honor your request.

8. Other website features

We offer visitors to our website various features for their information and enjoyment, which we may change from time to time. Your use of our website is subject to our Terms of Use.

9. Information we collect by automated means

We have implemented Google Demographics and Interest Reporting which, in the aggregate, groups our users into certain categories including: age ranges, gender, affinity categories, and in market segments.

10. Cookies

Like many companies, we use “cookies” on our website. Cookies are bits of text that are placed on your computer’s hard drive when you visit certain websites. We use cookies to tell us, for example, whether you have visited us before or if you are a new visitor and to help us identify website features in which you may have the greatest interest. Cookies may enhance your online experience by saving your preferences while you are visiting a particular website.

Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all our website features. You can manage your cookies here.

11. Web beacons

Certain pages on our website may contain “web beacons” (also known as internet tags, pixel tags, and clear GIFs). Web beacons allow third parties to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time the page containing the beacon was viewed, the type of browser used to view the page, and the information in cookies set by the third party.

12. Minors

Our website is not directed at children, and as a result we will not knowingly collect information from anyone under the age of 21. We will not knowingly market alcoholic beverages to anyone under the legal purchase age. If we receive notice or believe that someone under the legal purchase age has provided us with personal information, we will make every reasonable effort to remove such personal information from our files or flag such personal information and retain it for the sole purpose of ensuring that it is not used any further. If you believe we have inadvertently collected the personal information of a minor in your care, please contact us immediately so we may delete such information.

13. Sale or transfer of business or assets

We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use information you have provided through our websites in a manner that is consistent with this Privacy Policy.

14. Links to Third-Party Websites

From time to time, we may provide links to third-party websites. These websites may operate independently from us and may have their own privacy policies in place, which we strongly suggest you review if you visit any linked website. To the extent any linked website you visit is owned or operated by someone other than us, we are not responsible for its content or any use of the website.

15. How We Protect Personal Information

We maintain administrative, technical, and physical safeguards on this website to help protect against unauthorized disclosure, use, alteration, or destruction of the personal information you provide. We use secure socket layer (SSL) technology to help protect your credit card information as it is transmitted to us. You are responsible for maintaining the confidentiality of any user name and password you use.

16. Storage

Your personal information will be kept on servers in a physically and technologically secure environment located in the United States accessed only by authorized personnel or contractors who are bound to keep your information confidential. Any transmission of your credit card information will be encrypted. If you contact us regarding identity theft or some other form of unauthorized use of your data, we may disclose pertinent information to law enforcement agencies and other third parties with responsibility and authority to investigate such a claim.

17. Updates to Our Privacy Statement

This Privacy Policy may be updated, without prior notice to you, to reflect changes in our information practices. We will indicate at the top of the Privacy Policy when it was most recently updated.  If there are material changes to our Privacy Policy, we will provide other appropriate notice to you.
